The City of Hereford has adopted a ban on the sell, possession, and the discharging of fireworks within the city limits of Hereford. Anyone selling, possessing, or discharging fireworks inside the city of Hereford, will be issued a citation and all fireworks will be confiscated and destroyed as per city ordinance.

Sec. 42-121. Definitions.
The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Fireworks means any composition or device designed to produce a visible or audible effect by combustion, explosion, deflagration or detonation, and that is defined as "special fireworks" by 49 CFR 173.88(d) (1983), or as "common fireworks" by 49 CFR 173.100(r) (1983).

Sec. 42-122. Sale prohibited.
It shall be unlawful for any person to sell or barter or in any manner distribute any fireworks of any description whatsoever within the corporate limits of the city.

Sec. 42-123. To be discharged only at designated place.
It shall be unlawful for any person to fire, discharge or explode any Roman candle, rocket or other kind of aerial fireworks within the city, except at a place previously designated by the fire marshal and in accordance with methods and regulations previously prescribed by him, so that such fireworks shall not endanger any person and shall not be hazardous to surrounding property.

Sec. 42-124. Discharge prohibited in certain places.
It shall be unlawful for any person to fire or discharge, or cause to be fired or discharged, any firecracker, torpedo, Roman candle, rocket or other fireworks on, along or across any public street, square or alley or in any public meeting or assembly of people, or in any public hall, public building or auditorium within the city.

Sec. 42-125. Blank cartridges; explosive caps.
It shall be unlawful for any person to fire, discharge or explode any pistol, cane, cannon or other appliance using blank cartridges or explosive caps, on, along or across any public street, alley or square, or in any public meeting or assembly of people, or in any public hall, public building or auditorium within the city. Provided, that this section shall not apply to the use of such explosives on a stage in a dramatic or vaudeville performance.
